Privacy Policy

Eklipse Inc. (“Eklipse”, “we”, “us”) is a Delaware corporation with its principal place of business at 312 West 43rd Street, New York, NY 10036, United States.

This notice explains what personal information we collect through eklipses.io, our newsletter and our work with clients, how we use it, and the rights you have over it. It covers our website and communications. It does not cover third-party websites we link to.

For anything in this notice, including a request to exercise your rights, contact office@eklipses.io.

1. What we collect

Information you give us. Your name, email address, job title, company and anything else you choose to tell us when you fill in a form, subscribe to our newsletter, book a conversation, or email or call us.

Information collected automatically. Your IP address, browser type and version, device type, operating system, the pages you view, how long you spend on them, and the page you arrived from. This comes from cookies and similar technologies.

Information from clients. If you work at a client company, we may receive your name, role and contact details from that client during an engagement.

We do not collect special category data, we do not use credit reference agencies, and we do not buy contact lists.

2. How we use it, and why we are allowed to

We reply to enquiries you send us, relying on our legitimate interest in responding, or on the steps needed before entering a contract.

We deliver client work, relying on performance of a contract.

We send the newsletter, relying on your consent.

We measure how the site is used so we can improve it, relying on the consent you give through the cookie banner.

We keep business and tax records, relying on our legal obligations.

We protect the site from abuse, relying on our legitimate interest in security.

Where we rely on legitimate interests, those are running and improving a small consultancy, and we have considered whether that overrides your rights. You can object at any time.

We do not sell personal information, and we do not use it for automated decision-making or profiling.

3. Cookies and the newsletter

Cookies. Strictly necessary cookies keep the site working and are set without consent. Analytics cookies tell us which pages are read and are set only if you accept them. You can change your choice at any time through the cookie banner, or block cookies in your browser — parts of the site may then not work.

Our ● Cookie Policy lists each cookie, what it does and how long it lasts.

The newsletter. In Transit is sent through Beehiiv, which stores your email address and records whether you open an email or click a link so we can see which issues are read. Every email has an unsubscribe link, and unsubscribing takes effect immediately. Beehiiv processes this data on our behalf and has its own privacy notice.

4. Who else sees it

We share personal information only with service providers who process it on our behalf, under contract, and only as far as they need it:

  • Webflow, for website hosting
  • Beehiiv, for newsletter delivery
  • Google Analytics, for website analytics
  • Google Workspace, for email and documents
  • Our accountants and legal advisers, where an engagement requires it

We may also disclose information where the law requires it, to establish or defend legal claims, or to a buyer if the business is sold.

We do not share your information with advertisers, and we do not disclose it to any company outside this list for its own purposes.

5. Where your information goes

Eklipse is based in the United States, and our service providers are mostly US companies. If you are in the UK or the EEA, your personal information is transferred to the United States.

The United States does not have an adequacy decision for all transfers, so we rely on one of the following safeguards:

  • the UK–US Data Bridge or the EU–US Data Privacy Framework, where the receiving company is certified under it; or
  • Standard Contractual Clauses, with the UK International Data Transfer Addendum where relevant, in our contracts with providers that are not certified.

You can ask us for a copy of the safeguards that apply by emailing office@eklipses.io.

6. How long we keep it

  • Enquiries that do not become work: 24 months from last contact
  • Newsletter subscribers: until you unsubscribe, then 12 months
  • Website analytics: 14 months
  • Business and tax records: as required by US and Delaware law

When a period ends we delete the information or anonymise it so it can no longer identify you.

7. Your rights

Email office@eklipses.io to exercise any of these. We will respond within one month, and we will not charge you or treat you differently for asking.

If you are in the UK or the EEA, you can ask us to give you a copy of your information, correct it, delete it, restrict how we use it, or send it to another provider in a portable format. You can object to processing based on legitimate interests, and you can withdraw consent at any time — withdrawing does not affect anything done before.

You can also complain to a supervisory authority. In the UK that is the Information Commissioner's Office at ico.org.uk. In the EEA it is the authority in your country.

If you are a California resident, you can ask what personal information we have collected, disclosed or sold in the past 12 months, ask us to delete it, and ask us to correct it. We do not sell personal information and we do not share it for cross-context behavioural advertising, so there is nothing to opt out of. You can use an authorised agent, and we will not discriminate against you for exercising these rights.

Residents of other US states with privacy laws have similar rights, and we handle those requests the same way.

8. Security, children and changes

Security. We use access controls, encryption in transit and reputable providers to protect your information. No system is completely secure, so we cannot guarantee it, but we will tell you and the relevant authority if a breach puts you at risk.

Children. The site is not intended for anyone under 16 and we do not knowingly collect their information. If you believe a child has given us personal information, email us and we will delete it.

Changes. We will post any update on this page and change the date at the top. If a change materially affects how we use your information, we will tell subscribers by email before it takes effect.
